The cannabis situation – Is it actually legal?

Question by : The cannabis situation – Is it actually legal?
I saw this on a forum :

“cannabis is legal everywere believe it or not. there are three laws we have to follow, their called the common laws. so really, as long as you do not harm anyone, scam anyone or steal from anyone, you are not breaking the law, the law stating that cannabis is illegal is a statute not a common law, we do not have to follow statutes because another human being created them and no human has authority over another unless you give them that authority.

if a police man stops you in the street for suspicion on cannabis he will use sly words and trick you into giving them authority over you. they will say “im arresting you on suspicion of carrying a controlled substance, do you understand” when they say “do you understand” you would probably say yes. little did you know that they have then striped you of your rights as a human being and now have power over you.
when they say “do you understand” if you say” i take what you are saying into consideration, but i do not stand under you in anyway as i abide by common law” they then have no authority to search you or arrest you. you could literally just walk of and spark up a spliff in front of them, although thats a little cocky. hope this helps”

Can someone who is a little more clued up with the law expand on this?

Thanks!
Thanks guys – thought this was typical “technically blah blah blah im full of 5hit” talk. Particularly liked the story about the kid with his dad!

Another useless argument in favor of drugs, but no matter how you feel, or your attitude, and the laws passed by any state, California for instance where they have legalized it’s possession and use, the federal government still controls the sale, possession, and distribution and growing of it, and they, the feds, still deem it to be illegal.
One other thing so consider, do you or anyone else think that this prohibition is against constitutional law, then why do you suppose there are still so many people in jail for crimes involving this illegal substance, when the ACLU and hundreds of lawyers cannot seem to argue and win these cases in court.
The federal governments says it’s illegal, and they are the final word.

    Sure

He’s claiming that you don’t have to obey some actual laws. His claim is that the community/government/society’s laws aren’t valid as long as you’re not hurting anyone.

Then he has a bunch of nonsense where he thinks that a cop explaining why you’re going to jail is somehow a trick, rather than a real world occurrence You find this sort of nonsense coming out of Montana compounds, the types that used to claim no government beyond the county sheriff is valid. It’s largely based in an dogmatic logic system, one screwy guy with no actual knowledge of real world legal systems, who makes elaborate theories on what is legal based on the writing of various minor political science authors. These are inevitably the guys who proclaim you don’t need to get license plate, then shoot a cop when he stops them for not having a license plate.

They always remind me of an obnoxious kid I knew, who upon turning 18, gave his Dad a spit punctuated speech about how since he was an adult, he didn’t have to listen to him anymore or obey his rules, because he was a man. So his Dad said “Ok I’ll treat you like an adult then”, punched him once in the stomach, and put his stuff out on the lawn.
